The Privacy and Cookies Policy

The privacy policy describes the manner of processing User’s data collected with regard to using the Website mota-engil-ce.eu.


The owner of the Website and administrator of Users’ personal data is Mota-Engil Central Europe S.A. with its registered office in Krakow, at ul. Opolska 110, entered into the Register of Entrepreneurs conducted by the District Court for Krakow-Śródmieście, in Krakow, 11th Commercial Division of the National Court Register with KRS no. 00000012902, TIN:6750001573.

We have appointed a Data Protection Officer who you can contact by writing to the following address: iod@mota-engil-ce.eu or to the address of the administrator's office: ul. Opolska 110, 31-323 Krakow.

 

What data do we collect and how do we process it?

We collect Users’ personal data, if they voluntarily use forms, email addresses and telephone number available on the Website. Personal data is processed in compliance with the provisions of the Regulation of the European Parliament and of the Council (EU) 2016/679 of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (so called: GDPR). The scope and grounds for processing personal data depend on the purposes given below, for which we process it.

Grounds, purposes and period of data processing


1) Employees’ recruitment

 

In order to carry out the recruitment process, we process Users' personal data sent via the application form. In terms of personal data indicated in art. 22 (1) § 1 of the Labor Code (name (s) and surname, date of birth, contact details indicated by such person, education, professional qualifications, course of previous employment), the legal basis for the processing of personal data is to take action at the request of the data subject before concluding a contract (Article 6 (1) (b) of the GDPR) and fulfilling the legal obligation incumbent on the controller (Article 6 (1) (c) of the GDPR). Providing personal data by the User in the scope resulting from art. 22(1) § 1 of the Labor Code in connection with with art. 6 sec. 1 lit. b and c of GDPR is voluntary, but necessary to participate in the recruitment process.

If the User provides additional personal data (apart from those indicated in Article 22(1) § 1 of the Labor Code), the purpose of data processing is to conduct the recruitment process, the legal basis for the processing of personal data is the User's consent (Article 6 (1) (a) of the GDPR). Providing additional data by the User is voluntary. If the User does not want us to process additional personal data, please do not include them in the application form or in the documents sent. Failure to provide them does not affect the possibility of participating in the recruitment process, it will not be the basis for unfavorable treatment of the job applicant, and it will not cause any negative consequences to the job applicant, in particular, it will not constitute a reason justifying the refusal of employment.

If the User wishes to participate in future recruitment processes, the legal basis for the processing of personal data is then the User's consent (Article 6 (1) (a) of the GDPR), this consent is voluntary, failure to express it does not affect the possibility of participating in the current recruitment process .

The User's personal data will be processed for the duration of the current recruitment process, after which they will be deleted or until the consent is withdrawn (in the case of consent given in the current recruitment process for the processing of additional personal data, apart from those listed in Article 22(1) § 1 of the Labor Code). In the event of giving additional consent to participate in future recruitment processes, the User's data will be processed for one year from the moment the consent is given or until it is withdrawn, after this period it will be deleted.

2) Handling requests sent via the contact form or through the agency of email addresses and telephone numbers posted on the Website


In order to reply we process personal data sent by the User via the contact form or in other manner made available by us such, as: name and surname, email address, telephone number, contents of the request. We process data on the grounds of Article 6 section 1 letter f of the GDPR, i.e. within the administrator’s legally justified interest comprising execution of a request of the person whom the data concerns (receiving reply to the request). The data shall be processed until achieving the objective or raising an effective objection against processing thereof.

Is giving data obligatory?


Giving data is voluntary, yet, necessary to execute the User’s demand (in order to receive a reply to the request or participate in the recruitment).
 

www server logs

 

During visits and while browsing the Website, the User’s search engine automatically sends to the www server a set of temporarily saved information such, as: IP address, type of the search engine, language, access hours and website address from which the User has been redirected. This data is not associated with specific persons and we use them anonymously to manage the Website.

 

Cookies  

 

During a visit on the Website, on the User’s end device (computer, tablet, smartphone) small text files, which include information on the name of the webpage from which they come from, time of storing them on the device and a unique number, are automatically saved. Each cookie has an expiry date upon a lapse of which it is deactivated. Cookies are used to identify the device with which the User opens a webpage. We do not use cookies to determine the User’s identity. Statistical information regarding Users’ traffic, activity and manner of using the Website is delivered with the use of cookies.


The Website uses cookies in order to:

 

  • ensure proper operation of the Website, including adjusting the contents of the Website to the User’s preferences (cookies allow recognising basic parameters of the device such, as: its type, screen resolution, country from which the user logs on and therefore, accordingly present a webpage adjusted to the User’s needs e.g. in preferred language) - necessary cookies;
  • monitor traffic on the Website, anonymous analysis of Users’ behaviour and developing statistics (e.g. views of particular subpages, which allow us to better understand the manner of using the Website by Users and to improve it) - statistical cookies.


For the purpose of collecting anonymous statistical data, we use cookies or similar third parties’ technologies (so-called: third party cookie). For this purpose we use the analytical device:

 

  • Google Analytics (cookie administrator: Google Inc. with its registered office in the USA), used for analysing data which, with the use of cookies, collects information on users’ behaviour on the Website e.g. a source from which they came to us (via search engine, redirection from other website, social network, advertising campaign), location (state, city/town), software they use (operating system, search engine, the type of device), behaviour on the website (time of visiting a particular subpage, a number of visited subpages). Google does not use collected data to identify the User and does not link this information in order to enable identification of a particular person. How to manage cookies?


Search engines by default allow storing cookies on end devices. The User can change settings regarding cookies, in particular, so as to block automatic handling of cookies or inform of each case of saving them on the end device. Detailed information on the possibility and manners of handling cookies is available in the search engine settings. Furthermore, the User can at any time delete cookies by using available functions in the search engine they use. Limitations of using cookies can influence some functionalities available on the Website.

 

Data recipients

 

We can render the data available to entities authorised thereto under relevant legal regulations (e.g. the Police) and entities providing services to the benefit of the administrator related with the Website’s operation and processing data solely upon our request: to the Mota-Engil Group companies (Mota-Engil Central Europe Business Support Center Sp. z o. o. and Mota-Engil Real Estate Management Sp. z o. o. with their registered offices in Krakow), providers of telecommunications and IT services, suppliers of a recruitment platform, marketing agencies. Furthermore, we use suppliers who specify purposes and manners of using personal data themselves e.g. Facebook and Google. If the supplier’s registered office is located outside of the states of the European Economic Area, data is processed on the grounds of given personal data protection guarantees such, as the obligation to apply standard contractual clauses adopted by the EU Commission.

 

Links to other companies’ webpages  

 

The Website contains links to websites of other companies, and the User should read their privacy policies. We also use the so-called Facebook and YouTube plugins that allow you to directly redirect the User to our profiles on these websites. When you click on the plug-in (e.g. f, Like, YouTube), the User's browser is directly connected to the Facebook or YouTube server. If the User is logged in to one of the social networking sites at that time, information about visits to our Website will be sent to their servers, which can be assigned to the User's account on the given portal. If the User does not want to provide this data, before clicking on the plug-in, he should log out of the given social networking site. The legal basis for data processing is Art. 6 sec. 1 lit. f GDPR, i.e. the legitimate interest of the administrator consisting in promoting the administrator's activity. In connection with the use of plugins for social networks, the social network becomes a co-administrator of the User's personal data. Contact via social portals

 

You can also contact us via our social profiles on Facebook (e.g. via Facebook Messenger), YouTube, LinkedIn and Instagram. Data obtained with regard to the request sent to us via social portals is used solely for reply purposes. However, social portals collect personal data independently (with regard to users’ profiles developed by them); therefore, the User should read their privacy policies.

In the cases stipulated in the GDPR each User, with regard to their data, has the right to:

  • access data – Article 15 of the GDPR,
  • rectify data - Article 16 of the GDPR,
  • delete data - Article 17 of the GDPR,
  • limit data processing – Article 18 of the GDPR,
  • transfer data - Article 20 of the GDPR,
  • object data processing – Article 21 of the GDPR,
  •  revocation of consent in cases where it constitutes the basis for data processing - Article 7 of the GDPR

We reply to each request immediately, however, not later than within one month as of receiving it. In case we are not able to satisfy the User’s request within one month (e.g. due to the number of other users’ requests), we shall inform of postponing the deadline in advance. The User is also entitled to complain to the President of the Office for Personal Data Protection in case of stating infringing personal data processing provisions by the administrator.

 

Data security on the Website

 

Data is protected against unauthorised access by technical and organisational security measures. Apart from operational environment protection, we encrypt data with SSL report in order to hinder access thereto by unauthorised persons.

 

Amendments to the Privacy and Cookies Policy 

 

Any amendments hereto shall be made by publishing a new version on the Website.
